The session will cover:

  • The approach to policy interpretation in London and the Middle East’s common law courts, the GCC civil law jurisdictions, and in the Shari’a / Saudi law jurisdiction.
  • Resolving insurance disputes, parties involved, evidence that can be relied upon, and other considerations.
  • Considering the differences, the effect of different law/jurisdiction clauses on purported “back to back” reinsurance arrangements.
  • By way of example, will examine the different approaches to subrogation for each.
